Terms of Service

These Terms of Service ("Terms") govern the use of the ClockIn for Jira app ("the App"), developed and distributed by Fuksia Labs ("we") through the Atlassian Marketplace. By installing or using the App, you agree to these Terms.

1. Service description

ClockIn for Jira is a Jira Cloud app that allows users to record their working time through a clock-in system (start, pause, resume, stop), generate reports for team managers, manage incidents related to time records, and export data in CSV format for compliance purposes.

2. Account and access

Access to the App is through your existing Atlassian account. We do not create or manage separate user accounts. Your organization's Jira administrator controls who has access to the App and what role (employee, manager, or admin) is assigned to each user.

3. Acceptable use

You agree to use the App honestly and in accordance with applicable labor regulations. In particular:

• You will not enter false or manipulated clock-in data.
• You will not attempt to bypass, modify, or falsify the immutable event-recording system.
• You will use the incident system honestly to correct genuine errors, not to improperly alter records.

4. Plans and pricing

The App is a paid app, with tiered per-user pricing based on your organization's size. Pricing and billing terms are managed through the Atlassian Marketplace, in accordance with its own billing policies; see the app listing on the Marketplace for current pricing. Atlassian handles charges, renewals, and cancellations; we do not process payments directly.

5. Intellectual property

The App, its code, design, and brand are the property of Fuksia Labs. Data that you or your organization enter into the App (time records, comments, configuration) remains the property of your organization.

6. Service availability

The App runs on Atlassian Forge infrastructure. Service availability is subject to the availability of that infrastructure. We do not guarantee a specific uptime, although we strive to keep the App running correctly and to fix issues diligently.

7. Limitation of liability

The App is a supporting tool for working-time recording. Legal responsibility for complying with applicable time-tracking regulations rests with the employing organization, not with Fuksia Labs. We are not liable for penalties, inspections, or legal consequences resulting from misuse of the App or improper configuration by the organization's administrator.

To the extent permitted by applicable law, our total liability arising from use of the App is limited to the amount paid by the organization in the preceding 12 months.

8. Service changes

We may modify, improve, or discontinue features of the App. We will notify you of relevant changes through the Marketplace itself or the App's interface when reasonably possible.

9. Termination

Your organization's administrator may uninstall the App at any time from the Jira administration panel. Cancellation of a paid plan is managed through the Atlassian Marketplace.

10. Governing law

These Terms are governed by Spanish law. Any dispute arising from these Terms shall be submitted to the competent courts in Spain, unless applicable consumer protection regulations provide otherwise.
